Cadogan v Sportelli [2007] EWCA Civ 1042
The Court of Appeal has upheld an earlier decision by the Lands Tribunal which determined that the deferment rate used for calculating the premium for buying the freehold of houses should be 4.75% and 5% for flats. These deferment rates are now used to calculate the freeholder's right to vacant possession at the end of the lease.
The decision means that leaseholders today have to pay more than they would have done a couple of years ago, when the deferment rates were about 7%.

If the leaseholders of flats wants to buy the freehold but serve a defective notice on the freeholder, which is invalid, they can serve a fresh notice immediately without having to wait for 12 months.
